1. Acceptance of Terms

These Terms of Service govern your access to and use of https://www.transcompanion.com and the services made available through it. By using the site or creating an account, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the service. If you use the service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

    2. Age Requirement

    You must be at least 13 years old to use the service. If you are under the age of majority where you live, you may use the service only with permission from a parent or legal guardian, where allowed by law.

    By using the service, you represent that you have the legal capacity to enter into these Terms, that your use complies with applicable law, and that you will not use the platform in a way that harms others or violates their rights.

      3. Description of Service

      Trans Companion provides an AI companion chat platform that lets you interact with conversational characters and related features. The service may include account features, paid options, personalization tools, and community or support functions.

      AI-generated responses are produced by automated systems and may be inaccurate, incomplete, biased, or inappropriate for your situation. The service is for entertainment, companionship, and general informational use. It is not medical, mental health, legal, financial, or crisis advice.

        4. User Accounts

        Some features require an account. You agree to provide accurate information, keep it current, and use only accounts that belong to you or that you are authorized to use.

          Account Creation

          When you create an account, you may be asked for an email address, username, password, and other basic information. You must not impersonate another person, use misleading identity details, or create accounts for abuse, spam, or evasion of enforcement actions.

            Account Security

            You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account unless caused by our failure to use reasonable security measures. If you suspect unauthorized access, notify us promptly at legal@transcompanion.com and update your credentials right away.

              5. Acceptable Use

              You agree to use the service lawfully and respectfully. You may not use the platform to break the law, violate another person's rights, interfere with operations, or attempt to bypass safety or access controls.

              • Do not upload, request, promote, or distribute CSAM or any sexual content involving minors
              • Do not threaten, harass, stalk, defame, or target others with hateful or abusive conduct
              • Do not share non-consensual intimate content, doxxing material, or content that exploits or harms another person
              • Do not use the service for fraud, impersonation, phishing, malware, or unauthorized data collection
              • Do not attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the service or related systems
              • Do not use the platform in violation of applicable export controls, sanctions, or other laws

              6. Content and Intellectual Property

              The service includes software, design, branding, prompts, models, text, images, and other content protected by intellectual property and other laws. Your use of the service does not give you ownership of our technology or brand.

                Our Content

                We own or license the content and materials we make available through the service, including the Trans Companion name, logos, site design, and underlying software. Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable right to use the service for its intended purpose.

                  User-Generated Content

                  You retain rights in content you submit, to the extent you own them. By submitting prompts, messages, profile text, feedback, or other content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, process, and display that content as needed to operate, secure, improve, and enforce the service.

                  You represent that you have the rights needed to submit your content and that it does not violate law or these Terms.

                    7. Premium Features and Payments

                    Some features may require payment, subscription enrollment, or one-time purchases. Prices, billing terms, and included features will be shown at the time of purchase. By purchasing, you authorize the applicable payment provider to charge the selected payment method.

                      Subscription Plans

                      If you enroll in a recurring plan, your subscription will renew automatically at the interval shown during checkout unless you cancel before the next billing date. You are responsible for managing your subscription and keeping your billing information current. We may change pricing or plan features prospectively, with notice where required by law.

                        Refunds

                        Payments are generally non-refundable except where required by law or where we expressly state otherwise at the time of purchase. If you believe you were charged in error, contact legal@transcompanion.com promptly and include the relevant transaction details so we can review the issue.

                          8. Service Availability

                          We work to keep the service available, secure, and functional, but we do not guarantee uninterrupted access or error-free operation. Maintenance, updates, outages, third-party failures, or security events may affect availability from time to time.

                          We may add, remove, suspend, or change features at any time. We are not liable for delays, interruptions, data loss, or feature changes to the extent permitted by law.

                            9. Limitation of Liability

                            To the fullest extent permitted by law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment to the extent allowed by law.

                            To the fullest extent permitted by law, Trans Companion and its affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the service. Our total liability for claims arising from the service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or $100 if you have not made a payment, whichever is greater.

                              10. Indemnification

                              You agree to defend, indemnify, and hold harmless Trans Companion, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your misuse of the service, or your violation of these Terms or applicable law.

                              This section does not require you to indemnify us for claims caused by our own gross negligence, willful misconduct, or other liability that cannot be excluded under applicable law.

                                11. Termination

                                You may stop using the service at any time. We may suspend or terminate your access, remove content, or limit features if we believe you violated these Terms, created risk for us or others, failed to pay amounts due, or if we are required to do so by law.

                                Termination does not affect rights or obligations that by their nature should survive, including payment obligations, intellectual property provisions, disclaimers, limitations of liability, and dispute-related terms.

                                  12. Changes to Terms

                                  We may update these Terms from time to time to reflect changes in the service, legal requirements, or business practices. When we make material changes, we will post the updated Terms on the site and provide additional notice where required by law.

                                  By continuing to use the service after updated Terms take effect, you agree to the revised Terms to the extent permitted by law. If you do not agree, you must stop using the service.

                                    13. Governing Law

                                    These Terms are governed by the laws of the jurisdiction in which the service operator is established, without regard to conflict of laws rules, except where consumer protection law requires otherwise. If you are a consumer, mandatory rights under the law of your place of residence remain unaffected.

                                    Any dispute arising out of or relating to these Terms or the service will be resolved in the competent courts of that jurisdiction, unless applicable law gives you the right to bring a claim in another forum.
